1. Introduction

Welcome to Amesh ("Amesh", "we", "our", or "us").

These Terms & Conditions ("Terms") govern your access to and use of Amesh services, including purchases made through our retail stores, website, telephone ordering services, WhatsApp ordering channels, delivery services, and any future mobile applications or online ordering platforms operated by Amesh.

By placing an order, accessing our website, using our services, or interacting with Amesh, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our services.

2. Eligibility

You must be at least 18 years of age to purchase products from Amesh.

By placing an order, you represent and warrant that:

  • You are legally capable of entering into a binding agreement.
  • Information provided by you is accurate and complete.
  • You will use our services only for lawful purposes.

3. Products and Availability

Amesh specializes in the sale of fresh meat, poultry, fish, seafood, and related food products.

All products are subject to availability.

We reserve the right to:

  • Limit quantities.
  • Refuse orders.
  • Modify product offerings.
  • Discontinue products without prior notice.

Product images displayed on our website or future applications are for illustrative purposes only and may differ from actual products.

4. Orders

Orders may be placed through:

  • Amesh retail stores
  • Telephone calls
  • WhatsApp communication
  • Website inquiries
  • Future mobile applications
  • Other authorized ordering channels

Orders may also be created by authorized Amesh staff on behalf of customers based on instructions received in-store, over the phone, or through other communication channels.

Submission of an order request does not guarantee acceptance.

Amesh reserves the right to accept, reject, modify, or cancel any order at its sole discretion.

5. Pricing

All prices are displayed in Indian Rupees (INR).

Prices may change without prior notice due to:

  • Market fluctuations
  • Supplier pricing
  • Seasonal availability
  • Operational factors

Applicable taxes, delivery charges, and additional fees (if any) may be added to the final bill.

6. Product Weight Variations

Fresh meat and seafood products are natural products and may vary slightly in weight.

Where products are sold based on weight:

  • Actual delivered weight may vary slightly from estimated weight.
  • Final pricing may be adjusted based on actual weight supplied.

Reasonable variations shall not be considered defects.

7. Payment Terms

Amesh currently accepts:

  • Cash
  • UPI Payments
  • Other approved payment methods introduced in the future

Payment must be completed before or at the time of delivery unless otherwise agreed by Amesh.

Amesh reserves the right to refuse delivery or order fulfillment if payment obligations are not met.

8. Delivery Services

Home delivery is available only in selected service areas.

Delivery times are estimates and are not guaranteed.

Delays may occur due to:

  • Traffic conditions
  • Weather conditions
  • Product availability
  • Operational constraints
  • Circumstances beyond our control

Customers are responsible for providing:

  • Accurate address information
  • Correct contact details
  • Delivery instructions where necessary

If delivery cannot be completed because of incorrect information provided by the customer, additional delivery charges may apply.

9. Order Confirmation Links and Digital Services

Amesh may provide customers with secure links to:

  • Confirm orders
  • Review order details
  • Submit delivery addresses
  • Update customer information
  • Access future digital services

Customers are responsible for ensuring the accuracy of information submitted through such links.

10. Product Inspection and Acceptance

Customers are encouraged to inspect products at the time of delivery or collection.

Acceptance of the order constitutes confirmation that the products were received in satisfactory condition unless otherwise reported within the complaint period described below.

11. Quality Assurance

Amesh strives to provide fresh, hygienically handled, and high-quality products.

If you believe a product has a quality issue, you must notify Amesh within 2 hours of delivery or collection.

Where possible, customers should provide:

  • Photographs
  • Order details
  • Description of the issue

Amesh will review each complaint individually and determine an appropriate resolution.

12. Returns, Refunds and Replacements

Because our products are perishable food items, returns are generally not accepted.

Refunds or replacements may be considered only if:

  • Incorrect products were delivered.
  • Products were spoiled at the time of delivery.
  • Products were significantly different from the confirmed order.

Refund and replacement decisions are made at the sole discretion of Amesh after investigation.

Approved refunds may take several business days to process depending on the payment method used.

13. Product Handling and Food Safety

Fresh meat, poultry, seafood, and related products are perishable.

After delivery or collection, customers are responsible for:

  • Proper refrigeration
  • Safe storage
  • Hygienic handling
  • Appropriate cooking practices

Amesh shall not be responsible for spoilage, contamination, or quality deterioration caused by improper handling after delivery or collection.

14. Customer Responsibilities

Customers agree not to:

  • Provide false information.
  • Place fraudulent orders.
  • Abuse or harass Amesh employees.
  • Misuse promotional offers.
  • Interfere with our systems or services.
  • Use our services for unlawful purposes.

Violation of these Terms may result in suspension or refusal of future service.

15. Intellectual Property

All content associated with Amesh, including:

  • Logos
  • Branding
  • Product descriptions
  • Website content
  • Images
  • Software

is owned by or licensed to Amesh and protected under applicable intellectual property laws.

No content may be copied, reproduced, distributed, or used without prior written permission.

16. Limitation of Liability

To the maximum extent permitted by law, Amesh shall not be liable for:

  • Indirect losses
  • Consequential damages
  • Loss of profits
  • Business interruption
  • Data loss

Our total liability relating to any order shall not exceed the amount paid by the customer for that specific order.

17. Force Majeure

Amesh shall not be responsible for delays or failure to perform obligations caused by circumstances beyond reasonable control, including:

  • Natural disasters
  • Floods
  • Fires
  • Epidemics
  • Government restrictions
  • Transportation disruptions
  • Utility failures

18. Privacy

Use of our services is subject to our Privacy Policy.

By using Amesh services, you acknowledge that your personal information may be collected, processed, and stored in accordance with our Privacy Policy.

19. Changes to These Terms

Amesh may revise these Terms at any time.

Continued use of our services after updates constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Jalpaiguri, West Bengal.
