1. Introduction

Welcome to Amesh (hereinafter referred to as "we", "us", "our", or "the Company"). These Terms & Conditions ("Terms") govern your use of our mobile application ("App") and any services provided through it, including the ordering and delivery of fresh mutton, chicken, fish, and other non‑vegetarian products. By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Definitions

  • "App" means the Amesh mobile application.
  • "User" means any person who accesses or uses the App.
  • "Order" means a request placed by a User through the App to purchase products.
  • "Products" means fresh meat, chicken, fish, and related items listed on the App.
  • "Delivery Area" means the geographical zones where we offer delivery, as specified in the App.

3. Eligibility

You must be at least 18 years old to place orders via the App. By using the App, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

4. Account Registration and Security

To place an order, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts if we suspect fraudulent or abusive activity.

5. Orders and Acceptance

Orders placed through the App constitute an offer to purchase. All orders are subject to acceptance by us, which we may decline for any reason (e.g., product unavailability, delivery area restrictions, or payment issues). An order is confirmed only when you receive a confirmation notification via the App.

6. Pricing and Payment

All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes. Prices may change without prior notice. Payment must be made at the time of ordering using the payment methods available in the App (credit/debit cards, UPI, etc.). We do not store your payment information; all transactions are processed through secure third‑party gateways.

7. Delivery Policy

Delivery is available only within our specified Delivery Area. Estimated delivery times are provided during checkout but are not guaranteed. We will make reasonable efforts to deliver within the stated window; however, delays may occur due to traffic, weather, or other factors beyond our control.

Upon delivery, you or an authorized recipient must be present to receive the order. If no one is available, we may leave the order in a safe location at our discretion, but we are not liable for spoilage or theft after delivery. You are responsible for ensuring that the delivery address is correct.

8. Product Quality and Freshness Guarantee

We take pride in offering only the freshest, highest‑quality products. All meats, chicken, and fish are sourced from trusted suppliers and stored under hygienic conditions. If you are dissatisfied with the quality of a product, please contact us within 2 hours of delivery, and we will assess the matter. Our decision regarding quality issues is final.

Note: As our products are perishable, we cannot accept returns after the product has been handled or stored improperly by the customer.

9. Cancellations, Returns, and Refunds

Cancellations: You may cancel an order via the App before it is confirmed (i.e., before we begin preparation). Once confirmed, cancellations may not be possible. If we cancel an order due to unavailability or other reasons, you will receive a full refund.

Returns/Refunds: Given the perishable nature of our products, returns are generally not accepted. If you receive a product that is defective or does not match your order, please notify us immediately with photographic evidence. Refunds, if approved, will be processed to the original payment method within 7‑10 business days.

10. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with anyone;
  • Interfere with the operation of the App or attempt to gain unauthorized access;
  • Transmit any harmful code or engage in any activity that may damage our systems.

11. Intellectual Property

All content on the App, including text, graphics, logos, images, and software, is the property of Amesh or its licensors and is protected by Indian and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written consent.

12. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policyexplains how we collect, use, and protect your personal information. By using the App, you consent to such processing and warrant that all data you provide is accurate.

13. Limitation of Liability

To the maximum extent permitted by law, Amesh shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App or the purchase of products, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.

14. Indemnification

You agree to indemnify and hold Amesh, its affiliates, officers, and employees harmless from any claims, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, misuse of the App, or violation of any third‑party rights.

15. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, governmental actions, or technical failures.

16. Termination

We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately.

17. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Jalpaiguri, West Bengal.

18. Changes to Terms

We may revise these Terms from time to time. The updated version will be posted on the App, and the "Last updated" date will reflect the change. Your continued use of the App after any changes constitutes acceptance of the new Terms.
